In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, we inform you that the ownership of the domain of our Website [www.anese. es] corresponds to the ASOCIACIÓN NACIONAL DE EMPRESAS DE SERVICIOS ENERGETICOS (hereinafter, ANESE); association identified with C.I.F Nº G85836013, with registered office at calle Paseo de la Habana 4, 1º izda., Esc. 1. Object

Processing, always in compliance with and pursuant to the provisions of Regulation (EU)) 2016/679 of the European Parliament and of the Council of 27 April 2016 and Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, and any other implementing provisions.

ANESE undertakes to safeguard the privacy of any personal information provided by Users on the Website and, pursuant to the provisions of Regulation (EU)) 2016/679 of the European Parliament and of the Council of 27 April 2016 and other applicable legislation, hereby advises you that:

a) Policy development

Any personal data provided to ANESE, acting as the Data Controller, shall be held under the latter’s responsibility.

  1. The primary purpose of such information is to enable the management of users registered with the website, the provision of any services requested, and the sending of advertising material relating to the products and services marketed by ANESE. ANESE may forward these data to its providers in Spain or other countries, for internal database management purposes, or to the competent administrative or legal authorities in compliance with its legal and tax obligations. ANESE undertakes to safeguard the privacy of the information furnished and any other information it may have access to at any time, and shall under no circumstances disclose such information for any other purpose whatsoever without THE USER’s prior express consent.

THE USER declares that the information provided is true, accurate, complete and fully up to date, and shall be solely liable for any direct or indirect damages arising from failure to comply with such obligation. Should the information provided by a User belong to a third party other than the person providing it, THE USER shall inform such third party of the content of the present Policy and obtain their consent to the provision of their data to ANESE.

THE USER shall likewise advise ANESE of any changes in their personal information in order to ensure the proper management and quality of the service and of the data processed, in particular those regarding contact details, such as the address, direct debit bank account details, email address, telephone number, etc.

Where the request or service agreement is made by a legal entity, the consent given by its agents or authorised representatives pursuant to Article 21 of Spanish Law 34/2002 shall be deemed to have been given both on their own behalf and on behalf of the legal entity represented by them.

b) Consent

The personal data collected via the forms provided are required in order to process the USER’s request, and are therefore mandatory; otherwise ANESE will be unable to manage that request or service.

By submitting the forms, THE USER agrees to the processing of the data for the intended purposes of each form. ANESE shall not disclose the data to third parties except when so required by the law, when so authorised by the data subject or as provided for in the present Privacy Policy.

ANESE hereby advises the data subjects of its intention to send them marketing communications via email or any other equivalent means of electronic communication. The data subjects acknowledge such intention and expressly agree to receive such communications. THE USER’s consent to the disclosure of data hereunder may be withdrawn at any time, without retroactive effect.

Any personal data provided by THE USER for the provision of a service may be retained for at least the number of years required for compliance with legal and tax obligations, even following termination of the contractual relationship, until USER’s consent to that effect is withdrawn.

2. For what purpose do we process your data?

At ANESE we process the data provided to us by interested parties in order to manage different activities derived from specific procedures carried out within the scope of ANESE based on the functions and services offered through the app. Communication and management as well as the sending of information, etc. In this way, we will use your data to carry out some of the following actions:

  • Carry out the administrative, fiscal and accounting management of our clients and/or suppliers,
  • Resolve queries or suggestions about the services provided by the company’s app.
  • User Management.
  • Data protection rights management

We will not create commercial profiles based on the information provided and consequently we will not make automated decisions about you based on a commercial profile.

3. Treatment legitimation

The legal basis for the processing of the data provided is the execution of the service or request made by the User.

Sending of newsletters or bulletins: Consent of the interested party provided through their subscription and subsequent validation of their email account enabled for the receipt of communications of a commercial nature.

The sending of advertising, including by email about products and services, is based on the consent given by the User when requesting the services.

The fields of the forms on the Site marked with a red asterisk (*) are considered obligatory fields and must be completed in accordance with the circumstances in which they are requested. Otherwise you will not be able to continue with the registration process or contact ANESE.

4. Information storage time

The personal data provided by the user for the provision of a service will be kept for the duration of the commercial relationship or for the years necessary to comply with legal obligations. The data provided by the user in forms or requests for services will be kept for a period of two years from and from the last confirmation of interest made by the User.

The data are collected for the following purposes:

  • Addressing any questions, issues or suggestions regarding the services provided by ANESE.
  • Providing advice on the services provided by ANESE and on matters of interest to Users.
  • Sending information on the activities and events organised by ANESE and on the services provided by it.
  • Sending any requested quotations.
  • Sending marketing information on the services provided by ANESE.

5. Recipients of assignments

ANESE uses the social networks Twitter, LinkedIn, Facebook, Google+ and YouTube. Interaction with users through the use of such profiles or tools involves the international transfer of data of an analytical and technical nature in relation to the Site and network profiles, and the data provided by users through such profiles is processed by ANESE on its servers. Responsible for web analytics services: The Site has enabled Google Analytics services provided by Google LLC.

Interaction with users through the use of this tool involves the international transfer of data of an analytical and technical nature in relation to the Site.

The transfer is carried out under the EU-US Privacy Shield.

The data is collected for the following purposes:

  • Resolving queries or suggestions about the services provided by ANESE.
  • User registration: Management of user registration, creation of user account.
  • To allow Members access to restricted areas.
  • To provide technological, legal, environmental and web advice on the services provided by ANESE and on topics of interest to Members and Users of ANESE.
  • To provide information on job offers published by ANESE and to receive the Curriculum Vitae of interested parties.
  • To provide information on training days and thematic seminars organised and given by ANESE and to manage the registration of interested parties.
  • Send information on the activities and events organised by ANESE and the services provided.
  • Sending of newsletters or bulletins: Management of commercial communications associated with the user to partners, collaborators or customers of our website by any means, including electronic ones.

7. Privacy policy – contact form

ANESE is responsible for the processing of the User’s personal data, and therefore provides you with the following processing information:

  • Purpose of processing: to deal with queries made to us through this form.
  • Legitimation: by ticking the acceptance box, you are giving your consent for your data to be processed in accordance with the purposes of this form described in this privacy policy.
  • Data retention criteria: data will be retained for as long as there is a mutual interest in maintaining the purpose of the processing and when it is no longer necessary for that purpose, it will be deleted with appropriate security measures to ensure the pseudonymisation of the data.
  • Recipients: data will not be disclosed to any third party.
  • Rights of the User:
    • Right to withdraw consent at any time.
    • Right to object and to the portability of personal data. Right of access, rectification and deletion of their data and to limit or oppose their processing.

In the collection and processing of personal data, appropriate security measures have been adopted to prevent loss, unauthorised access or manipulation of the same, in accordance with the provisions of Royal Decree 1720/2007 of 21 December. The Site has the SSL Certificate (Secure Socket Layer), in order to guarantee the security of data transmission between your browser and our Site. The secure server establishes a connection so that the information is transmitted encrypted, which ensures that it is only intelligible to the user’s device and that of the Site. In this way, by using the SSL protocol, it is guaranteed that: (i) that the user is communicating their data to the Page’s server centre and not to any other; (ii) that between the user and the Page the data is transmitted encrypted, preventing its possible reading or manipulation by third parties.
  7. ANESE undertakes to protect the confidential information to which it has access.
  8. The data provided by users will not be transferred to third parties, unless there is a legal obligation.
  9. ANESE will not use in any case the personal data that the User makes available to provide services other than those referred to in paragraph c) of this document or, where appropriate, to achieve its own utility or other than that authorised by the owner of such data.
  10. We inform you that we will not carry out any international transfer of data.
  11. The User certifies that he/she is over 14 years of age and therefore has the necessary legal capacity to consent to the processing of his/her personal data, in accordance with the provisions of this Privacy Policy and Legal Notice.

The User may, at any time, exercise their rights of access, rectification, cancellation, opposition or revocation of the consent previously granted regarding the processing of their personal data, by sending ANESE a duly signed letter to our postal address indicated above, clearly stating their contact details, which must be accompanied by a photocopy of their DNI/NIF or document proving their identity.
  13. Finally, we inform you that you have the right to lodge a complaint with the supervisory authority, the Spanish Data Protection Agency, either through its electronic headquarters or at its address, Calle Jorge Juan nº 6, (28001), Madrid.
